These Terms of Service (“Terms”) govern your use of Thoughtline (“Service”), operated by Business Insiders Media LLC (“we”, “us”, or “our”), a Wyoming limited liability company. By accessing or using Thoughtline at thoughtline.co, you agree to be bound by these Terms.

1. About Thoughtline

Thoughtline is a personal AI health companion designed to support emotional wellbeing through daily check-ins, reflections, and pattern recognition. It is not a medical service and does not provide medical advice, diagnosis, or treatment.

If you are experiencing a mental health crisis or medical emergency, please contact emergency services (911 in the US, 000 in Australia, 999 in the UK, or 112 in the EU) or a qualified healthcare professional immediately.

2. Eligibility

You must be at least 18 years of age to use the Service. By using Thoughtline, you represent that you meet this requirement. The Service is not intended for use by minors.

3. Account Registration

To use Thoughtline, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your password confidential and not share it with others
• Notify us immediately if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Billing

Free trial: Thoughtline offers a 7-day free trial. No charge is made during the trial period.

Subscription fee: After the trial, the Service costs A$14.99 AUD per month, billed monthly.

Automatic renewal: Your subscription renews automatically each month unless cancelled before the renewal date.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

Changes to pricing:We may change subscription pricing with at least 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

5. Refund Policy

All payments are non-refundable. We offer a 7-day free trial so you can evaluate the Service before being charged. No refunds or credits will be issued for partial months, unused periods, or any other reason, except where required by applicable law.

Australian users: Nothing in these Terms limits any rights you may have under the Australian Consumer Law, including consumer guarantees that cannot be excluded.

UK/EU users: Nothing in these Terms affects your statutory rights under applicable consumer protection law.

6. Acceptable Use

You agree not to use Thoughtline to:

• Violate any applicable law or regulation
• Impersonate any person or entity
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any commercial purpose without our written consent
• Input false, misleading, or harmful information

7. AI-Generated Content

Thoughtline uses artificial intelligence to generate reflections, insights, and responses. You acknowledge that:

• AI-generated content is not a substitute for professional medical, psychological, or therapeutic advice
• AI responses may occasionally be inaccurate, incomplete, or not appropriate for your specific situation
• You use AI-generated content at your own discretion and risk

8. Intellectual Property

All content, design, and technology comprising the Service is owned by Business Insiders Media LLC or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

You retain ownership of any personal content you submit (your check-in responses, reflections, etc.). By submitting content, you grant us a limited licence to use it solely to provide and improve the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Business Insiders Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Business Insiders Media LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with reasonable notice. You may terminate your account at any time by cancelling your subscription and contacting us.

Upon termination, your right to use the Service ceases immediately. We may retain your data as described in our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

For users in Australia, the UK, or EU, nothing in these Terms removes your rights under mandatory local consumer protection laws.

15. Dispute Resolution

We encourage you to contact us first if you have a concern. For users in the EU, you may also use the EU Online Dispute Resolution platform.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Continued use after the effective date of changes constitutes acceptance.
